Cooling Off Day Breaches since 2011… and what happened to them

Switched on my computer this morning and I get swarmed with reports and comments on social media on Cooling Off day breaches. Lot of angry people out there even among some of my friends. Cries of the lack of fairness in the treatment of the latest breaches.

Is that really so?

Here’s the nice thing about having Google. You put in a little research, use a bit of your common sense, normally the other perspective emerges very quickly.

Here’s what I found.

GE2011

1. Our dear super act cute at that time Tin Pei Ling’s account posted a comment on that day.

Defence: Page administrator who posted without her knowledge

Outcome: Page administrator given stern warning by police

2. The real super cute and hot Nicole Seah’s account made a post

Defence: Party volunteer accidentally posted

Outcome: Police accepted volunteer’s explanation, no further action link

3. Nicole Seah’s account posted again on Polling Day, saying she would be checking on her complaint about Tin’s Cooling Off Day breach. The irony is that cooling off restrictions apply on Polling Day too. link

Defence and outcome: none. Seems like no police report was made.

GE 2015 link

1. Smart Nation guy Vivian Balakrishnan’s Facebook and Twitter accounts posted

Defence: It was an old Facebook post which was automatically reposting on both Facebook and Twitter, despite multiple attempts to stop it. Facebook (which claimed recently it doesn’thave any political bias) confirmed this was caused by a glitch.

Outcome: The Elections Department reminded him and the posts were taken down. No further action.

2. The People’s Power Party page posted rally speeches

Defence: Took longer to upload rally speeches than expected.

Outcome: The Elections Department reminded them and the posts were taken down. No further action.

3. The Reform Party’s page posted

Defence: Unknown.

Outcome: The Elections Department reminded them and the posts were taken down. No further action.

BE 2016 – Blatant disregard of the law.

1. The Independent Singapore posted on Cooling Off Day. Even after the Elections Department reminded them not to post, they still kept posting.
2. and 3. Teo Soh Lung and Roy Ngerng, whom the Elections Department called “regularly engag(ers) in the propagation, promotion and discussion of political issues”

Outcome: The Elections Department has made a police report and the police is investigating.

Now, the internet is aghast at the police searching Teo’s and Ngerng’s houses and seizing their phones and computers without a warrant. Even the SDP and WP have issued statements about this.

I see several problems with this:

1. The police can search without a warrant if the offence is arrestable, as Cooling Off Day breaches are.

From the Criminal Procedure Code

It is claimed that Teo and Ngerng admit to making the posts. But they might not say the same in court. The police have to be thorough and establish evidence on who made the posts. To do this, it’s not inconceivable that they need Teo and Ngerng’s social media passwords and devices. Anyway, the offences were allegedly posted on Facebook. Where does one to go to to investigate? If a crime is committed and evidence is in a bedroom, police ask for the lock and search the bedroom. Why should social media be different?

2. These cases can be seen as a higher level of offence.

Most of the previous cases, whether PAP or opposition, received a reminder. But The Independent persisted in posting even after receiving a reminder. This is surely a higher level of offence and warrants a more thorough investigation.

Most of the previous cases (again on all sides of the political fence) were either slip-ups or posts that somehow went up slightly after the restrictions kicked in and were quickly deleted. But Teo and Ngerng, in a climate when the Cooling Off rules were widely publicised, repeatedly posted political posts. Teo made 12 posts from Cooling Off Day to before the polls closed. In the same period, Ngerng posted a “photo campaign” for Chee on his blog, which he claims has more than 6.5 million hits, and 30 Facebook posts. The police can very well view these as deliberate and repeated transgressions, and investigate more thoroughly than before. They were not minor slips. They were major election campaigns!

3. Why are SDP and WP issuing statements about the police investigations?

This is the first time any politicians, let alone parties, have gone beyond explaining themselves to questioning the investigations. SDP is closely linked to Teo and Ngerng, and WP NCMP Leon Perera is one of the advisors of The Independent. They must be viewed as having interest in the investigation, and their statements attempts to influence them. They should not be seen as interfering with police investigations with people related to them. Clearly they should understand they are interested parties.

4. And finally, what is the matter with this Jeanette Chong-Aruldoss woman?

Why is she entering the fray everywhere, from trying to abuse the court procedure last week to police investigations this week? Now they are saying the policemen are not carrying cards. As long as the lead officer in charge of the team is carrying the warrant card, it is enough.

Obviously, some of these people are trying to put the police in the bad light and trying to throw people off the real offence. Remember Jeanette is the same person who recently abused the court process to defend a brutal murderer.

The Real Reason PM Lee Sued Blogger Roy Ngerng

Money politics has always been synonymous with South-East Asian governments. Whether allegations are true or not, any hint of it will likely be believed.

Needing to stand apart from our competitors in the region, Singapore has always gone out of its way to be a clean and efficient government. This adherence to the rule of law and the uncompromising emphasis on transparency of process is the primary reason Singapore has succeeded well ahead of our region's counterpart. Roy Ngerng's allegation that PM Lee had misappropriated money from CPF funds invested in our sovereign wealth fund was therefore an attack on the very basis of Singapore's success. Such an allegation cannot go unchallenged as any hint of an unclean government would impact Singapore and Singaporeans.

 

A case in point being PM Najib's current political troubles where he had been accused of siphoning 940 million into his own account. PM Najib had chosen to remain silent and his act of not resisting has only spurred his detractors on to say that it must be true hence his silence. This scenario would not be different for PM Lee. If PM Lee Hsien Loong had chosen to turn the other cheek, opposition members like Kenneth Jeyaretnam, Chee Soon Juan and Low Thia Khiang would have jumped on the bandwagon and Singaporeans (and would be investors) would then assume that PM Lee was guilty.

 

At the end of the day, perception is reality. Hence, politicians like Lee Kuan Yew, Goh Chok Tong and PM Lee Hsein Loong have no choice but to pursue legal actions to protect their reputation. Failing to sue, is an admission of guilt. In fact, opposition members like Ravi Philemon, Goh Meng Seng and even Vincent Law have resorted to threats of legal actions to defend their reputation.

Roy Ngerng Defamation Suit: What it really means ....

In 2 day's time, on 1 July 2015, CPF activist Roy Ngerng will have his day in court. In accordance with Singapore law, Roy will be given the opportunity to question Prime Minister Lee Hsien Loong over the PM's defamation suit of him. Opposition supporters will definitely cheer this as a win for Roy but, on the contrary, it is a loss. Allow me to explain why ...

#1: Free and Transparent Government. The fact that a normal citizen can face his accuser (who happens to be the Prime Minister of the day) demonstrates that no one is above the law. No one, not even the Prime Minister, can ignore the law of the land and due process will be served. If this is not a free and transparent Government, I don't know what is. Even in the United States, the bastion of democracy, ex-President Bill Clinton did not stand trial for his alleged indiscretions with regards to Monica Lewinsky.

#2: Defamation Suits are "standard practice" to protect one's reputation. PM Lee and the Ministers are not the only ones to use defamation suits, or the threat of suits, to defend their name and reputation. In recent months, opposition activists like Ravi Philemon, Goh Meng Seng and even Vincent Law have in one form or another used the threat of legal actions to get clear their name. If free speech indeed comes with no limits, how do these opposition activists justify their own use of the law for such purposes?

#3: Abuse of process for self-promotion. As Roy Ngerng has already been found guilty by the Court for defamation, Roy's decision to question PM Lee Hsien Loong is clearly a ploy for his own self-promotion. After all, which political activists in Singapore can claim to have questioned the Prime Minister. In our assessment, Roy is desperately hoping to regain loss support after his heckling of special needs children at Hong Lim Park. Since that incident, many Singaporeans have seen Roy for the true person that he is and have stopped supporting him. In fact, despite promises, Roy Ngerng has to date not given a full accounting of the crowd sourced defence fund he has raised.

In short, we feel that while 1st July 2015 is a sad day for Singapore as the Prime Minister will need to face a misguided activist, we are hopeful that this Court hearing will demonstrate to all Singaporeans and political observers that Singapore is a true democracy.

In an interesting week, the darling of the opposition has turn out to be their worst nightmare. Trying to capitalize on the so-called unjust “persecution” of a young child exercising his constitutional right to free speech, activists like Roy Ngerng, Vincent Law (an aspiring SDP candidate for GE2016), Jolovan Wham and Alfian Sa’at threw themselves behind Amos Yee.

Unfortunately for them, Amos was wiser than they thought and he "out-ed" them for the fakes that they are. In a lengthy blog post titled “The Molestation Of Vincent Law”, Amos gave a blow by blow account of how these hypocrites attempted to exploit him for their own political gains.

In Amos’ mind, Vincent Law is a “charlatan, a huckster, a hypocrite and a fraud.” According to Amos, Vincent is now hounding his mother, demanding that Amos issue a public apology to him and his family. Otherwise Vincent would get a lawyer to sue him. Amos rightly pointed out that if Vincent was truly standing up for him and is fighting for freedom of speech, Vincent would be fighting against the laws that claims that even if somebody lies, mocks or offends a person or large amounts of people, it should not be deemed as a criminal offense. But now, when the cause that Vincent so boldly advocated, is used unfavorably towards him, he is now threatening to use those exact same laws that he went against, to sue Amos.

According to Amos, even Roy Ngerng is a hypocrite. Roy told Amos that it’s going to be so hard for us to advocate for you, now that you’ve humiliated Vincent. That is when Amos responded that "if my fanbase consists of hypocrites, then despite your support I wouldn’t want it. When things looks bad, and you threaten to remove the support you once had for me. Then fine, good riddance. If that’s the kind of support I receive, one that’s so easily withdrawn, then believe me, I do not wish to acquire your quote unquote ‘support’."

In short, Amos Yee, in our opinion has single-handedly destroyed opposition activists like Roy Ngerng, Vincent Law and Alfian Sa’at by revealing their true characters. If Singaporeans have seen first-hand the true character of Roy, Vincent and Alfian, some good has come out of Amos Yee saga.

In the latest twist to the Amos Yee saga, it now appears that Amos was "assaulted" on his way to his pre-trial conference on 30 April 2015. Unconfirmed sources tell us that the Singapore Democratic Party (SDP) had hired a "hit-man" to slap Amos to malign the Government and to win sympathy votes for Amos.

In a video spreading on social media, Amos Yee was seen walking to court alone when an unknown man, in a red t-shirt walked up to him and slapped him. For dramatic effect, Amos Yee is seen clutching his face for the camera.

From the video, it is clear that the slapping incident was staged. Firstly, it happened in an area where reporters were congregating to ensure that it was captured. If it was a real assault, it would realistically have happened in a more secluded area away from the cameras. Secondly, the video was perfectly positioned to capture the entire scene. The way it zoomed in and followed the path of the perpetrator was uncanny and could only have been achieved with pre-planning. Thirdly, the speed at which the alternate media uploaded the video and opposition members condemning it was unreal. Without forewarning, this would not have been possible.

In short, Singaporeans need to know the lengths at which opposition activists will act to mislead the public and malign the government.

In a surprising move, welcomed by netizens, teenage wannabe dissident Amos Yee spent last night in remand (jail) after his own parents refused to bail him out.

Amos Yee is the Singapore 16 year old who was charged in court for posting a video with the intention of hurting the religious feelings of Christians and another video containing remarks about the late Mr lee Kuan Yew which offended people. Amos was previously granted police bail pending his court case on the explicit condition (which he accepted) not to post, upload or distribute anything related to the case.

On April 14, Amos Yee deliberately breached his bail conditions when he blogged and posted on Facebook, asking for public donations. While this cannot be confirmed, many netizens believe that Roy Ngerng and Leong Sze Hian are behind Amos Yee's last actions to challenge the Singapore judiciary. Undated pictures of Amos Yee and his mother meeting with Roy and Sze Hian have been circulating online and this comes in addition to news that Amos Yee had met with senior members of the Singapore Democratic Party days before his seditious video was posted. There are also pictures of Roy Ngerng standing in the shadows at Amos' pre-trial conferences.

In a move seen to demonstrate the severity of his offence and that he should not treat court orders lightly, the court has also ordered Amos Yee to report to his investigation officer at the Bedok Police Station at 9 am every day as part of his new bail conditions.

While Yee had agreed to the new conditions, his parents refused to bail him out. The prosecution then asked the Judge to vary the bail condition to allow a Singaporean other than Yee’s parents to post bail. But the Bail Office closed at 4:30 pm, the same time Yee’s closed-door meeting ended.

Amos Yee - More Trouble-maker Than Innocent Youth

As the spot-light begins to shine on Amos Yee, more evidence is emerging to support the theory that he is not a misguided youth, but a political activists out to discredit the Government.

In the attached picture, taken from Amos' own Facebook page, his disdain for his parents is obvious. What sort of son would publicly call his own mother "an absolute bitch?" Most definitely someone who is ungrateful and without the proper values to appreciate, or at least show respect, to someone who has raised you. 

Perhaps one cannot fully blame Amos Yee. After all, the following picture shows the type of people he mixes with. People like Roy Ngerng himself who is a public failure who goes around the world denouncing Singapore and Singaporeans. Someone who (in my opinion) embezzled money from trusting Singaporeans while pretending to champion transparency and accountability.

If there was ever any doubt that Amos Yee should get his just desserts, I think all that is gone.

Continuing in his deranged quest for attention, Roy Ngerng recently gave an interview to the Hong Kong tabloid Apple Daily where he denounced the reputation of Singapore and Singaporeans.

In his interview, Roy continued to martyr himself by saying that he hoped that his sacrifice will embolden Singaporeans to vote for the opposition. Roy also criticized Singaporeans for not having the courage to stand-up to the PAP and for abandoning him in his quest to get the Government to return our CPF. Roy's anger about being abandoned stems from the fact that he received over $100,000 in donations to fight a defamation suit against Mr Lee Hsien Loong, but this had stopped after it was revealed that Roy had not been as open and transparent about how the money was being spent. To date, no proper accounting has been provided by Roy Ngerng or his stooge Han Hui Hui about how the money was spent.

 

In response to Roy's claims that Singaporeans are afraid to vote for the opposition, Roy cannot be more wrong. If the so called fear exists, how then do you account for the fact that the Worker's Party won seats at the last election and how do you explain that the government only got 60% of the popular vote.

 

The truth of the matter is that Singaporeans are not afraid to vote for the opposition. The truth is that Singaporeans know credible candidates from the failures. So Roy, stop denouncing Singaporeans and wake-up to the truth that Singaporeans just won't vote for failures like you and Han Hui Hui. Like Minister Chan Chun Sing once said, the crux of the matter is not that Singaporeans have not heard Roy Ngerng. The crux of the matter is that they have heard Roy Ngerng and they have chosen to ignore him.

It is interesting to note that in response to news that Roy Ngerng, Han Hui Hui and four other protestors would be charged in court for the role in the 27 September 2014 Hong Lim Park heckling incident, Leong Sze Hian immediately posted an appeal on his Facebook page asking for people to come forward to stand bail and pay the expected $6,000 fine and legal fees.

It is a well-known fact that Leong Sze Hian has been mentoring Roy Ngerng and Han Hui Hui on how to use civil disobedience to force the Government to review the CPF system and the much debated minimum sum requirement.

As an observer, Leong Sze Hian’s Facebook post raises many questions. Firstly, where was Leong Sze Hian during the protest gone wrong? Did he instigate Roy Ngerng and Han Hui Hui to do his bidding and then take the cowardly act of standing aside to watch what happens? Rumours have it that Leong Sze Hian told Roy and Hui Hui that he needed to be “innocent” so that he can act on their behalf if they were arrested.

The second question is why is there a need to appeal for six people to stand bail? Can’t Sze Hian himself stand bail for Roy or Hui Hui? Or is Leong afraid that his puppets will not show-up in court and he will then be liable for Roy and Hui Hui’s actions. Once again, rumours have it that Leong Sze Hian is unwilling to put himself in this potentially difficult position.

The third question is why is there a need to appeal FOR MONEY to pay the expected legal fees and fine? Didn’t Roy Ngerng claim to have raised over $110,000 for his legal defence fund? As such, isn’t there a huge surplus which will enable Roy to pay the small $6,000 fine plus legal fees? Or, could it be that Roy’s claim of massive public support is a scam? Surprising, many donors have been calling for Roy to be transparent with how he has used the FUNDS, but he has remained silent on the matter. Isn’t Roy guilty of the same thing he is accusing the Government of?

It is this observer’s view that Roy Ngerng and Han Hui Hui are mere puppets in enabling Leong Sze Hian’s to achieve his personal agenda. Hopefully, Leong Sze Hian’s actions when the chips are down will open Roy’s and Hui Hui’s eyes to the fact that they are being used.

Roy Ngerng to Flee Singapore Reveals M Ravi

SINGAPORE. In a video published on 6 February 2015 on M Ravi's Facebook page, M Ravi tells Singaporeans that that Roy Ngerng Yi Ling has "siphoned money" from the public donations he has collected and "intents to leave Singapore" to seek asylum in Norway.

While SG General Elections 2016 has long suspected that Roy Ngerng has no intentions to abide by the court's judgement, this is the first time that we have proof of Roy's true intention. We place high credibility on M Ravi's statement that Roy Ngerng indeed plans to flee Singapore with the donations simply because M Ravi is a lawyer and he is well aware of the dangers of defamation. In addition, M Ravi has been a close support of Roy Ngerng and he is very likely to be in a position to know of Roy's game plan.

Singapore GE 2016, sincerely hopes that this credible revelation by M Ravi about Roy Ngerng will convince Roy's remaining supporters to abandon their support of Ngerng. SG General Election 2016 (and many other former supporters) have been asking Roy Ngerng to account for the money he has collected, but to date we have not received any replies.

"Fool me once, shame on you. Fool me twice shame on me." It is time for Singaporeans to stop being fooled by Roy Ngerng.

Roy Ngerng Interview with Joel Lazarus: "I want to save the world"

In a recent interview with British academic and activist, Roy Ngerng declared his "intentions to save the world". Apparently, Roy Ngerng is not content with trying to save Singaporeans, but now sees it as his calling to save the world.

We at SG Bumiputra are not sure who Roy's thinks he is, but his antics are bordering on being delusional. Surely Roy Ngerng must know that the world does not need his saving.

Has Blogger Roy Ngerng Embezzled Singaporeans Money?

On 13 January 2015, the Singapore courts ordered blogger Roy Ngerng, who was found to have defamed Prime Minister Lee Hsien Loong last November, to pay Mr Lee Hsien Loong S$29,000 for legal fees and related expenses. The final damages to be awarded is still being assessed and will be decided at a late date.

 

 

The Prime Minister filed the defamation suit against Ngerng in May last year. The suit arose from a blog post by Ngerng that same month titled "Where Your CPF Money Is Going: Learning From The City Harvest Trial", which alleged that CPF monies had been misappropriated.

 

In November, a judge ruled that Ngerng had defamed Mr Lee with his posts. The blogger was ordered to be restrained from publishing or disseminating the allegation that Mr Lee is guilty of criminal misappropriation of the monies paid by Singaporeans to the Central Provident Fund, or any words and/or images to the same effect.

 

In a rare update on the Roy Ngerng Legal Defense Fund, Roy remarked “I suppose that is all I have left in donations and you might just as well use it up, why don’t you?” This is extremely puzzling as Roy had claimed to have raised in excess of $110,000 (more than the required $70,000) for his legal defence fund in 4 days.

 

Since then, despite his promise to be transparent and to account for all the monies he has collected, repeated calls by Singaporeans for Roy Ngerng to provide an update on the fund usage has gone unanswered. The calls for an update began when it was rumoured that Roy and Han Hui Hui had used the money to fund extravagant “study trips”.

In the clearest sign that the money well intentioned Singaporeans had provided Roy Ngerng is gone, a source close to Roy says that he is getting ready to make another appeal for donations.

 

We wonder if any of the well-meaning Singaporeans scammed by Roy Ngerng of their money will file a police report for criminal misappropriation.

 

Han Hui Hui and Roy Ngerng Cry Foul

In typical opposition fashion, the likes of Han Hui Hui, Roy Ngerng and Leslie Chew are hypocrites. On the one hand, they call for restraint on the part of government supporters not to online CSI them and publish their details online, but on the other they do the same.

 

 

Opposition supporters have had it too good. In the past, they were the only ones online spreading lies and attacking the Government. In those times, opposition supporters simply intimidated government supporters by shouting them down and outing them in public. Things have however changed and the so-called silent majority has woken-up to the need to fight for the Government they believe has done good work, and will continue to do good work for Singapore and Singaporeans.

 

Not to take things lying down, the silent majority is now giving the opposition and their supporters a taste of their own medicine. If you don't like being out-ed online, then don't out others.

Han Hui Hui: Facebook Post She Does Not Want You to See

On 11 August 2014, Han Hui Hui made an appeal on her Facebook page for Singaporeans to come forward and pay Roy Ngerng a monthly salary of $5,300 a month. The money, according to Han Hui Hui is to make Roy Ngerng Singapore's "first full-time Nominated Member of Parliament (NMP) that is truly selected by the people."

 

SG Leaks received a screenshot of Han Hui Hui's Facebook post and apparently after receiving no support and being flamed for the idea, Han Hui Hui has taken down the post.

 

 

From what we can gather from sources close to Han Hui Hui and Roy Ngerng, the pair's end game is clear. Continue to instigate attacks against the government to provoke a reaction and then to play the sympathy card as the victims of political oppression. The end state being to gain a political appointment and the more than $5,300 that comes with it. It remains to be seen if any of the legitimate political parties in Singapore will field Roy Ngerng and Han Hui Hui as their candidate in GE 2016.
